TERMS AND CONDITIONS

By purchasing goods and services from Lilies Water Gardens you enter a legally binding contract with us on the following terms.  You should read and understand these terms because they affect your rights and liabilities.

These terms describe the basis for purchase by you and sale by us of the products and services described on this web site.

Definitions and interpretation

In these terms the following words have the following meanings:

Contract

The contract for the sale and purchase of the goods and services.

Delivery Area, Postage and Packaging

We deliver to the entire mainland UK, Scottish Islands, Northern Ireland, Southern Ireland, Isle of Man, and Channel Islands. 

The postage and packaging prices are as follows:-

Mainland UK £10.00

Northern Ireland £ 20.00

Southern Ireland £30.00

Scottish Highlands £20.00

Scottish Islands £30.00

Isle of Man £30.00

Channel Islands £30.00

Please ensure you choose the correct drop down box when placing your order so that the relevant postage and packaging charge is added to the invoice.

All orders are despatched on a premier 24-hour next day delivery basis.  We cannot guarantee next day delivery to remote parts of Scotland, Northern and Southern Ireland, the Isle of Man and the Channel Islands.  All orders must be signed for on delivery unless we are given special instructions at the time of the order.

Details of the order

The quantity, quality and description of the Goods will be those set out in your order.  Orders are accepted at our sole discretion but are normally accepted if the Goods are available; you are based in the Delivery Area and have chosen the correct postage and packaging charge; and your credit or debit card has been authorised by PayPal for the transaction.

Price of the Goods

The price of the goods is as shown on our website (less any applicable discount) and will not increase between the date we accept your order and the delivery date.  Our charges for postage and packaging are as detailed above and will be included in the total price for the Goods.

Payment terms

Payment is due at the time of placing your order, for all Goods, using PayPal, a secure payment facility.  PayPal accepts all major credit and debit cards and you do not need to be a member of PayPal.  In the unlikely event that we are unable to process all or part of your order we will contact you, by telephone, within 7 days of receipt of your order.  We will offer either to refund your order, in full, or refund part of your order. We will endeavour to process the refund within 7 days of receipt of your order. 

Delivery

We will deliver the Goods to the address you specify for delivery in your order.  It is important that this address is accurate.  It is a condition that all orders despatched will require a signature on delivery, and, unless you have specified special instructions when you placed your order, we will never leave items unless they have been signed for.  We cannot accept any liability for any loss or damage to the Goods once they have been delivered and signed for. 

We will aim to despatch the Goods within 7 days of the date of the order.  If delivery is delayed due to any cause beyond our reasonable control we will contact you   by telephone and advise you.  You will then be offered the choice of a full refund or a revised delivery date.

Risk and ownership

Risk of damage to or loss of the Goods passes to you at the time of delivery to you.  You will only own the Goods once they have been successfully delivered.

Warranties

We aim to provide high quality products.  Customer satisfaction is very important to us.  Please tell us, either in writing or by telephone, if you are not happy with any aspect of our service.

Matters out of our control

We will not be liable to you or in breach of the Contract for delay or failure to perform due to a cause beyond our reasonable control.

Privacy

We will not pass on your details to any third party other than to the delivery company for the purpose of delivering your order.

Governing law and jurisdiction

English law will govern these terms and any disputes will be resolved exclusively by the English Courts.
