By purchasing goods and services from Lilies Water Gardens you enter a legally binding contract with us on the following terms. You should read and understand these terms because they affect your rights and liabilities.
These terms describe the basis for purchase by you and sale by us of the products and services described on this web site.
Definitions and interpretation
In these terms the following words have the following meanings:
The contract for the sale and purchase of the goods and services.
Delivery, Coverage, Postage and Packaging
Orders sent out with delivery instructions are delivered at the customers own risk, we cannot be held responsible for parcels left without a signature
Postage and Packaging is charged on all orders unless otherwise stated.
We will deliver the Goods to the address you specify for delivery in your order. It is important that this address is accurate. It is a condition that all orders dispatched will require a signature on delivery unless special delivery instructions are given when placing a order. We will never leave items unless they have been signed for. We cannot accept any liability for any loss or damage to the Goods once they have been delivered and signed for. We will aim to deliver the Goods by the date quoted for delivery but delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative time.
All orders are dispatched within 5 days and delivered within 48-hours (UK Only) from time of dispatch. Orders sent 2nd Class Royal mail can take up to 4 working days to be delivered. We cannot guarantee next day delivery to remote parts of Scotland, Northern Ireland, the Isle of Man, and the Isle of Wight. All orders must be signed for on delivery unless we are given special instructions at the time of the order.

Details of the order
The quantity, quality and description of the Goods will be those set out in your order. Orders are accepted at our sole discretion but are normally accepted if the Goods are available; you are based in the Delivery Area and have chosen the correct postage and packaging charge; and your credit or debit card has been authorised by PayPal for the transaction.
Price of the Goods
The price of the goods is as shown on our website (less any applicable discount) and will not increase between the date we accept your order and the delivery date. Our charges for postage and packaging are as detailed above and will be included in the total price for the Goods.
We will charge your credit card account for payment upon receipt of order unless delivery cannot be fulfilled within 30 days. Items with a lead-time greater than 30 days will be charged up to 7 days prior to dispatch. We accept no liability if a delivery is delayed because you did not give us the right payment details. If it is not possible to obtain full payment for the Goods from your account on delivery of the Goods to you, we can cancel the Contract or suspend any further deliveries to you. This does not affect any other rights we may have.
We will take all reasonable care to keep all information connected with your order secure but we cannot be held liable for any loss that you may suffer if a third party obtains unauthorised access to any data, including credit and account details you provide when accessing or ordering from this Web Site, unless this is solely due to our negligence. In the unlikely event that we are unable to process all or part of your order we will contact you, by telephone, within 7 days of receipt of your order. We will offer either to refund your order, in full, or refund part of your order. We will endeavour to process the refund within 7 days of receipt of your order.

Returns/Options to cancel
By law, customers within the European Union have the right to a ‘cooling off period’ within 14 days of their purchase being delivered.
If you decide to return an item to Lilies Water Gardens during this period, you will only be entitled to a refund of our range of "non-living"/non-perishable products in their un-opened unused state, the cost of the item and not the return charge.
If you are however returning the items because they are damaged, faulty or in any way defective then Lilies Water Gardens will refund the delivery and return fee on receipt of the goods. Photo evidence must be provided if plants or dry goods are damaged upon delivery.
We only offer a refund on plants if they are damaged on arrival and the customer alerts us within 24 hours of delivery. All our plants are dispatched in a clean healthy state, we do not guarantee plants as they are living and prone to airborne pests and diseases, unsuitable soil, location, and weather conditions, all of which are out of our control.
Risk and ownership
Risk of damage to or loss of the Goods passes to you at the time of delivery to you. You will only own the Goods once they have been successfully delivered.
We aim to provide high quality products. Customer satisfaction is very important to us. Please tell us, either in writing or by telephone, if you are not happy with any aspect of our service.
Matters out of our control
We will not be liable to you or in breach of the Contract for delay or failure to perform due to a cause beyond our reasonable control.
We will not pass on your details to any third party other than to the delivery company for the purpose of delivering your order.
Governing law and jurisdiction
English law will govern these terms and any disputes will be resolved exclusively by the English Courts.
